Pure Encapsulations does not use "nonGMO" or "GMO-free" on its soy product labels because the FDA has recently targeted several nutraceutical companies for using this terminology.
According to the FDA, terms like "not genetically modified" and "GMO free," which include the term "modified" are not technically accurate unless they are clearly in a context that refers to bioengineering technology. The suggested alternatives for labeling statements include "We do not use ingredients that were produced using biotechnology" or "These soybeans were not genetically engineered." However, we feel that it is only a matter of time before the FDA decides against this terminology as well.
The FDA has also stated that the term "GMO free" may be misleading on most foods, because most foods do not contain organisms (seeds and foods like yogurt that contain microorganisms are exceptions). It would likely be misleading to suggest that a food that ordinarily would not contain entire "organisms" is "organism free."
For more information about the FDA's actions and outlook on the labeling of non genetically modified ingredients, visit www.fda.gov and conduct a search on "GMO labeling".
